Are there differences in my student’s rights and how they are addressed at a postsecondary institution?
- Section 504 of the Rehabilitation Act of 1973 (Section 504) and Title II of the Americans with Disabilities Act of 1990 (Title II) prohibit discrimination on the basis of disability.
- Several requirements that applied in high school are different from requirements beyond high school.
- In high school, Section 504 requires a school to provide a free appropriate public education (FAPE) to each child with a disability in that jurisdiction.
- Postsecondary institutions under the law are required to provide a student appropriate academic adjustments, as necessary, to ensure there is no discrimination on the basis of disability.
